Terms of service

1. Scope and definitions

These terms govern all contracts between KOLJA ANNUSSEK MANAGEMENT EURL, 9 Rue des Colonnes, 75002 Paris, France (the "seller") and customers for goods and services offered on koljaannussek.com and in the private showroom. A "consumer" is a natural person contracting for purposes outside their trade or profession; a "business" is a person or entity acting for commercial purposes.

2. Formation of contract

Product presentations on the site are invitations to order, not binding offers. An order is submitted by completing checkout and clicking "place order". The seller may accept within five days by written order confirmation, by dispatch of the goods or by a request for payment. For PayPal payments the contract is formed when the customer confirms the payment. For showroom commissions, the contract is formed by written confirmation of the commission.

3. Right of withdrawal

Consumers have a statutory right of withdrawal of fourteen days. The conditions, the exclusions for made-to-order and personalised goods and the model withdrawal form are set out in the Return Policy.

4. Prices and payment

Prices stated are total prices including VAT. Delivery charges are shown separately. Payment is possible by card via Shopify Payments (processed by Stripe), Apple Pay, PayPal and bank transfer. Bank transfers are due immediately on conclusion of the contract unless otherwise agreed. Leather pieces shown as "price on request" are quoted in writing after a fitting.

5. Shipping and delivery

Goods are shipped to the delivery address provided, within the EU, the UK and the United States; other destinations on request. In-stock items are processed within 1–3 business days; standard delivery takes 3–7 business days, international delivery 10–14. Made-to-order pieces take 8–10 weeks in production. If a delivery fails for reasons attributable to the customer, the customer bears the costs, except where the customer has validly withdrawn or the carrier is at fault. Collection in person is possible only by appointment in the showroom. If the seller's own supplier fails to deliver, the seller may withdraw from the contract and will refund any payments immediately.

6. Retention of title

The seller retains ownership of the goods until full payment has been received.

7. Defects and guarantee

The statutory rules on liability for defects apply. For business customers the limitation period for new goods is one year; claims for used goods are excluded. Consumer rights remain unaffected. Visible transport damage should be reported to the carrier and to the seller without delay; failing to do so has no effect on the customer's statutory rights.

8. Liability

The seller is liable without limitation for intent and gross negligence, for injury to life, body or health, and under any guarantee given. For negligent breach of an essential contractual obligation, liability is limited to the foreseeable loss typical of the contract. Any further liability is excluded.

9. Made-to-order and personalised goods

Numbered pieces made to the customer's measurements are made to the consumer's specifications. The customer confirms the skin, the measurements and the lead time in writing before production starts; after that point the order cannot be cancelled and the right of withdrawal does not apply. Where the customer provides content for personalisation, the customer must hold all necessary rights and indemnifies the seller against third-party claims; the seller may refuse orders that infringe the law or public morality.

10. Vouchers

Promotional vouchers are redeemable only within the stated period and only in the online store; one voucher per order, no cash refund of balances, and the credit is forfeited if the order is withdrawn. Purchased gift vouchers can be redeemed until the end of the third year after purchase; remaining balances are credited to the voucher account, and vouchers are redeemed before completing the order and are not paid out in cash.

11. Governing law

French law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence.

12. Dispute resolution

The EU Commission provides a platform for online dispute resolution at https://ec.europa.eu/odr. The seller does not take part in proceedings before a consumer arbitration board. French consumers may refer a dispute to the consumer mediator named in the Legal Notice.
